Sand License

 

Application of license on getting of Sand in the sea-bed under Continental Shelf Act 1966 (Revised 1972).

 

1. Level of Application


Each application shall use form of First Schedule of the Continetal Shelf Act, 1966 (Revised 1972) along with application fee of RM 1,000.00 by cheque/bank draft/ money order/ postal order in the name of "Federal Lands Commissioner".

Attachment of Application Process

Documents need to be attached when apply:

  • Completed First Schedule Form;
  • Plan and the cooridnate of applied area which is certified by the Director General of Department of Survey and Mapping Malaysia;
  • Memorandum ; Articles of Association;
  • Form 24 and Form 49, Company Act 1965;
  • Offer letter of sand supply or memorandum of understanding or agreement document with company that will buy or use the sand (if any).

Federal Lands Commissioner (PTP) has the right to reject any incomplete application or applied area overlaps with the approved license.

 

2. Policy Approval Stage

In a period of twelve (12) months from the date of approval of the policy, applicants are required to :

  • Conduct Environmental Impact Study (EIA) and obtain the approval of the study from the Director General of Department of Environment.
  • To carry out hydrographic surveying (pre Dredge survey) and obtain the approval of the Hydrographic Branch, Royal Malaysian Navy.
  • Submit one (1) copy of the marine sand supply agreement between the applicant and the purchaser (if it has not been submitted).

 

3. Licenses Issuance Stage

Once the requirements in para 2 are executed, the applicant must settle the following fees for the issuance of the license:

  • Payment of Licence Fee at the rate of RM1,000.00 for every 2.59 km square area approved or part thereof in the form of a cheque/bank draft in the name of "Federal Lands Commissioner".
  • Payment of security deposit in compliance with license conditions amounting to RM100, 000.00 in the form of a cheque / bank draft in the name of "Federal Lands Commissioner".
  • Payment of security deposit for Fishermen's Welfare Trust Fund of RM100, 000.00 into the "Trust Account" in the name of the Director General of Fisheries Malaysia;
  • Advance royalty payment equal to 30% of the total value of the royalty to be paid based on the total volume of sand to be supplied by the applicant to the buyer as stipulated in the agreement between the applicant and the purchaser.
  • (Royalty set at 70 cents per 1 cubic meter of sand taken). Payment by cheque / bank draft in the name of "Federal Lands Commissioner".
