Small Estate Distribution Act 1955

 

Small Estate Distribution Act 1955 was previously known as Small Estate Distribution Ordinance 1955. It is the main law used in dealings involving small estates. To date there have been amendments made to the act.

 

Overall the act explains the meaning of small estate and states the scope of power, work process that starts from the application of hearing, the issuing of order until the appeal process in the High Court. Apart from that, there are laws in the distribution of small estates that lays down the process of execution and usage of forms in the completion of small estate distribution.

 

In distributing of small estates, the Faraid Law is applied for estates owned by Muslims, and the Distribution Act 1958 is used for non-Muslim estates. The basis of Faraid is according to the Quran and the Hadith among which is the verse 11, 12 and 176 of the Surah An Nisa.
