Small Estate (Distribution) Act, Ammendment 2008 (Act A1331) and statues enforced begining from 1st September 2009.

Definition of Small Estate

The definition stated in Section 3(2) Small (Distribution) Act 1955 explains small estate as properties left behind by a deseased that comprises in full or in part on immobile properties in any states with the total value of the said properties not exceeding RM 2 million on the date of application (begining 1st September 2009). Without being confined by the stated value, all properties left behind by a deseased non-Muslim who had written a will under the Will Ordinant No. 38, 1959 is not defined as small estate. It is considered big estate and it is the responsibility of the High Court. However this provision is not applicable in cases of Muslim deaths because it goes against the law and rules of inheritance in Islam.
